CARRYING WEAPONS

Carrying Weapons is far and away the most common weapons related criminal charge that is filed in Iowa.  Many law abiding citizens can accidentally find themselves accused of violating these provisions.

A person commits and aggravated misdemeanor if the person:
  1. Goes armed with dangerous weapon concealed on or about person; or
  2. Within limits of any city goes armed with pistol or revolver or any loaded firearm of any kind, concealed or not; or
  3. Knowingly carries or transports a pistol or revolver in a vehicle.
 A person who goes armed with knife and uses it in commission of crime commits an aggravated misdemeanor.
 
A person armed with knife concealed on or about person, if the person does not use it in commission of crime:
  1. If blade exceeds 8 inches commits an aggravated misdemeanor;
  2. If the blade exceeds 5 inches but is less than 8 inches commits a serious misdemeanor.

EXCEPTIONS TO CARRYING WEAPONS

The offense of carrying weapons doesn’t apply if:
  1. The person is in their own dwelling, place of business, or on land owned or possessed by person;
  2. The person is a member of armed forces when weapon carried in connection with duties as such;
  3. The person is carrying for lawful purpose, an unloaded weapon inside closed and fastened container or in securely wrapped package too large to be concealed;
  4. The person is carrying or transporting an unloaded pistol or revolver in a vehicle inside closed and fastened container or securely wrapped package too large to conceal or inside a cargo or luggage compartment where pistol or revolver is not readily accessible to any person in the vehicle;
  5. The person is lawfully engaged in target practice on a range designed for that purpose or while hunting;
  6. The person is carrying a knife used in hunting or fishing while lawfully engaged in hunting or fishing;
  7. The person possesses and is able to display a valid permit to carry.

CARRYING WEAPONS ON SCHOOL GROUNDS

A person commits a class “D” felony if the person goes armed with, carries, or transports a firearm of any kind, concealed or not on school grounds, unless the person is authorized by the school to do so, or the weapon is in a closed and fastened container or in securely wrapped package too large to be concealed
