Drivers License Saved, OWI Avoided

Client's driver's license was spared when the arresting officer failed to give him the opportunity to place requested phone calls at the jail following his arrest.  The prosecution was left without use of the test refusal at trial and agreed to amend the charge to a simple misdemeanor offense of public intoxication the morning of trial.
