Dubuque, Dubuque County, Iowa. OWI charge amended to simple misdemeanor of reckless driving after GRL Law discovered that the arresting officer gave incorrect information to GRL Law's client prior to submitting to the breath test. Video showed that the arresting officer informed GRL Law's client that the breath testing at the station was only for driver's license purposes when the reality is, the test result is also used in the criminal prosecution. This misadvisory resulted in the breath test result being thrown out and the prosecution being willing to amend the charge to a simple misdemeanor. The misinformation also resulted in the license suspension being avoided as well.
