Greenfield, Adair County, Iowa. One incorrect sentence by arresting officer makes all of the difference. Arresting officer advised GRL Law client that he did not have the right to an in-person consultation with anyone other than an attorney. Iowa law however, provides that a person arrested for Operating While Intoxicated has the right to an in-person consultation with a family member in addition to an attorney. Consequently, the officers misstatement to GRL Law's client resulted in exclusion of the breath test. Ultimately GRL Law's client keeping his driving privileges and the charge of Operating While Intoxicated was amended down to a Simple Misdemeanor, Reckless Driving with the minimum fine of $65 being imposed.
