Altoona, Polk County, Iowa. OWI 1st offense amended to reckless driving and driving privileges spared. GRL Law’s client was pulled over for speeding leaving Prairie Meadows Casino. Client respectfully invoked her rights, refused field sobriety testing and requested an opportunity to consult with an attorney before making a decision to take or refuse the breath test. The officer prematurely interrupted and terminated client’s attempt to contact an attorney which resulted in the prosecution agreeing to exclude her subsequent refusal of the breath test. Given the officer’s testimony at the Department of Transportation license suspension hearing, the prosecution agreed to amend the charge to a simple misdemeanor reckless driving. Operating While Intoxicated charge avoided and driving privileges were saved.
