OWI 1st Offense Amended to Public Intoxication and Driver’s Licenses Saved

Des Moines, Polk County, Iowa. Man arrested for sleeping in his running car at the Iowa State Fairgrounds saw his Operating While Intoxicated charge amended to the simple misdemeanor offense of Public Intoxication. The Court also suppressed his breath test because the arresting officer improperly limited his phone calls after arrest so his driving privileges will be reinstated.
