OWI Charge Amended to Public Intoxication Following Serious Accident

Jasper County, Iowa.  Client was arrested for operating while intoxicated when the blood tests taken after his accident revealed a blood alcohol concentration of .163.  The charge was amended to public intoxication because the arresting officer failed to sign the implied consent form which prohibited the Department of Transportation from suspending his license and prohibited the admissibility of the test result against him in the criminal proceedings which hindered the State's ability to show that he was intoxicated at the time of the accident.
