Jasper County, Iowa. Client was charged with OWI first offense following a failed breath test result. GRL challenged the admissibility of the breath test result based on a violation of the client's right to obtain his own independent test. The State agreed tha the client's rights were violated and suppressed the breath test result from being used at trial. As a result, the State amended the charge to reckless driving and the Department of Transportation was prevented from suspending the client's drivers license.
