Wapello County Iowa. Client's OWI charge was ultimately dismissed and his license was saved after it was determined that his telephone calls to his wife at the jail had been recorded. As a result, a motion to suppress was filed challenging the admissibility of the evidence in his case and the Court ultimately entered an order throwing his breath test refusal out. The criminal charge was dismissed and the Department of Transportation was not able to suspended his license.
