OWI Dismissed License Saved

Ames, Story County, Iowa.  A Story County Judge concluded that client's right to independent testing was violated when officer failed to provide him with an affirmative opportunity to obtain independent testing after it was requested.  The violation resulted in the breath test result be excluded as evidence and the prosecution agreed to dismiss the drunk driving charge.  Because the breath test result was excluded, the Department of Transportation will be required to reinstate client's driving privileges.
