OWI First Offense to be Dismissed After Illegal Traffic Stop

Pella, Marion County, Iowa. Marion County Judge ruled that Pella Police Department officers did not have a sufficient legal basis to stop a vehicle being driven by GRL Law's client. Law enforcement received a call about a suspected intoxicated female at a community event. Law enforcement tracked down a vehicle that the intoxicated person was believed to have gotten into. No information was ever obtained regarding who the driver of that vehicle was prior to stopping the vehicle. Officers observed no signs of impaired driving but stopped the vehicle anyways. GRL Law's client was simply driving the intoxicated friend home in the intoxicated friends vehicle. Judge ruled that the stop of the vehicle was illegal. Driving privileges will be reinstated and all charges against GRL Law's client will have to be dismissed.
