Refusal of Breath Test ruled inadmissible at trial

Wright County, Iowa. Prosecutor agrees that breath test refusal in OWI 1st offense is inadmissible at trial after GRL Law's Grant Gangestad argued that his client's constitutional rights were violated when a breath test was requested of him without constitutional authority to do so under the Iowa Constitution.  With the breath test refusal suppressed, the client was able to obtain a deferred judgment, allowing him to avoid jail time, additional fines and fees, and eventually allowing the record of the OWI to be expunged from the client's record.
