Request to re-take Test Saves License

Grimes, Polk County, Iowa.  A request to re-take the breath test administered at the Polk County Jail saves GRL Law's client's driving privileges and avoids an operating while intoxicated conviction.  After being provided with the result of the breath test at Polk County Jail, GRL Law's client requested to re-take the breath test.  The officer refused and also failed to inform GRL Law's client about her right to independent testing.  This violated her right to independent testing and prevented the Iowa Department of Transportation from revoking her driving privileges.  License spared and OWI charge avoided.
