Never Disclose Prescription Medications to Law Enforcement During a Traffic Stop

Winterset, Madison County, Iowa.  GRL has been warning anyone who will listen NOT to disclose prescription medications to law enforcement during a traffic stop.  This most recent GRL NFG demonstrates precisely why this is.  GRL’s client provided a breath sample of .037 but disclosed that he was taking his non-controlled substance medication.  The urine test that GRL’s client consented to confirmed the presence of only the prescription medication.  A young and aggressive officer, fresh off of training for driving while drugged investigations, even with the test results, still charged GRL’s client with Operating While Intoxicated and Child Endangerment.  Thankfully, GRL […]

Child Endangerment and Domestic Assault Causing Injury Charges amended to Disorderly Conduct

Boone County, Iowa-A GRL Law client was facing domestic assault and child endangerment charges after the client’s ex-girlfriend made allegations that he had assaulted her tried to push her down a flight of stairs while she was holding the child.  As the matter approached trial, the State’s attorney was convinced by Mr. Gangestad to dismiss the charges of child endangerment and domestic assault and amend them to a disorderly conduct charge, a simple misdemeanor.  The client was able to retain his firearms and hunting rights as a result.

OWI and Child Endangerment Charges Dismissed

A Dubuque County woman was charged with OWI and two counts of child endangerment after her estranged husband called the cops on her after they got into a verbal argument while swapping visitation of their children.  When officers arrived the husband advised that he wanted them to check his wife to see if she had been drinking, despite him not smelling alcohol or observing any signs that she had been drinking.  Three law enforcement agencies arrived at her residence and spoke with her.  Despite none of them smelling an odor of alcohol or making any observations that led them to […]

Review of Video and Law Saves Client

Client was charged in Dallas County with OWI and Child Endangerment for allegedly driving under the influence with her 14-year-old daughter in the vehicle.  A review of the Iowa Code showed that the State was required to dismiss the Child Endangerment charge because the legal definition of a child for that Code section is a person under the age of 14.  The State agreed to suppress Client’s breath test results after a review of the video showed that the officer administered the breath test prior to making a written request for the sample as required by Iowa law.  Client’s driver’s […]
