Polk County, Iowa- Prosecutors filed several commercial vehicle violations against GRL Law’s client totaling several thousand dollars in potential fines. After attorney Grant Gangestad filed a motion to dismiss based upon defects in the prosecution, several of the tickets were dismissed with costs assessed to the state. The client was able to save several thousand dollars in fines and avoided the loss of his employment.

After reviewing GRL Law’s motion to suppress evidence challenging a Department of Transportation Motor Vehicle Enforcement officer’s constitutional authority to randomly stop and inspect commercial vehicles, the prosecutor agreed to suppress GRL Law client’s urine test refusal and dismiss the operating while intoxicated charge.
Providing incorrect information about a commercial driver’s license prevented the State from suspending a drivers license for a failed breath test.
