Never Disclose Prescription Medications to Law Enforcement During a Traffic Stop

Winterset, Madison County, Iowa.  GRL has been warning anyone who will listen NOT to disclose prescription medications to law enforcement during a traffic stop.  This most recent GRL NFG demonstrates precisely why this is.  GRL’s client provided a breath sample of .037 but disclosed that he was taking his non-controlled substance medication.  The urine test that GRL’s client consented to confirmed the presence of only the prescription medication.  A young and aggressive officer, fresh off of training for driving while drugged investigations, even with the test results, still charged GRL’s client with Operating While Intoxicated and Child Endangerment.  Thankfully, GRL […]

NFG! First Three-Word Verdict of 2023 in Guthrie County OWI

A unanimous Guthrie County jury returned the first NFG of the year yesterday following a two-day OWI trial. It took just under 30 minutes for the jury to say GRL’s client was not guilty. Two seasoned Guthrie County Sheriff deputies testified that they believed the driver was intoxicated based on their training and experience. And the State argued the jury could consider his eventual refusal to submit to breath testing was a tacit admission that he would blow over the legal limit. CDL Saved After Urine Test Results Suppressed

In the process of saving a CDL from being disqualified, the impaired driving attorneys at GRL exposed a potential flaw in the implied consent advisory for commercial motor vehicles. The advisory provides that commercial driving privileges will be disqualified if the drivers tests over 0.04 for alcohol or refuses testing while operating a CMV. Reciprocity Defense for Medical Marijuana Results in Two Dismissals

Frequent visitors to the GRL Law Blog are no doubt familiar with our approach to defending medical marijuana charges. NFG! Court Dismisses Charge Against CDL Driver

The State cited our client for driving an unsafe vehicle after the trailer detached from his rig while on the highway.  The evidence showed the kingpin likely failed after the driver’s last inspection. We defended the case on the merits, but also raised challenges to the citation process and notarization at the close of the state’s case. The trial court finally issued a ruling on our motion for judgment of acquittal.  It was certainly worth the six-month wait! The court dismissed the citation because of a lack of compliance with Iowa Code section 805.6 with costs assessed to the State. […]

NFG! Court Dismisses Four Citations Against CDL Driver

GRL Law secures yet another dismissal for a CDL driver.  DOT enforcement stopped our client for driving past an open scale.  The officer conducted a Level I inspection and ultimately cited her for multiple violations. Plea negotiations ended abruptly when the officer refused to cut any slack.  So we tried all four charges to the magistrate. The officer admitted on cross-examination that he was never placed under oath when the citations were “notarized.”  The Iowa Constitution requires that all cases be tried on information under oath. NFG! Court Dismisses Log Book Violation Against CDL Driver

Another CDL ticket trial, another NFG verdict for the driver! Our client was charged with log book violations for not having a few records of duty status in his possession.  He was on the road only two days that month when stopped by the Iowa DOT enforcement officer.  And the truck was not equipped with an ELD.
