All Charges, Including Vehicular Homicide and Leaving the Scene of Fatality Accident, dismissed in Burlington Motel fatality.

Burlington, Des Moines County, Iowa.  All charges against GRL Law's client, initially charged with Vehicular Homicide, by Operating While Intoxicated and Leaving the Scene of a Death Accident, have now been dismissed.  The Vehicular Homicide charge was initially dismissed on January 7, 2015 after prosecutors conceded that they were unable to establish the defendant's alcohol concentration or impairment at the time of the fatal accident.  On May 18, 2015, the County Attorney filed a motion to dismiss the final remaining count of Failure to Stop and Remain at the Scene of an Accident Involving Death, citing an inability to prove the defendant's knowledge of the accident taking place.  The motion was granted on May 20, 2015.

The charges were filed following the death of the two-year-old child at the Midtown Motel, located in Burlington, Iowa, after the child was struck by a vehicle in the parking lot at 9:30 p.m.  Client was initially facing a mandatory 25 year sentence if convicted of the Vehicular Homicide charge and an additional 5 year sentence on the Leaving the Scene count. All charges filed in this prosecution have now been dismissed with costs associated with the case being assessed against the State.
