Guthrie Center, Guthrie County, Iowa. What started as a stop for not having an operational license plate light transformed into a full-blown criminal investigation and operating while intoxicated charge. GRL Law challenged the investigating officer's interrogation of our client as well as the prosecutions ability to use his refusal of chemical testing against him at trial. The Court agreed that the interrogation was improper and also precluded the prosecution from using the breath test refusal against him at trial. The case was ultimately resolved by pleading guilty to the license plate light citation. Driving privileges spared and OWI avoided.
