NOT GUILTY VERDICT IN UNLAWFUL PASSING TRIAL

Washington, Polk County, Iowa.  On February 26, 2021 a magistrate judge found our client not guilty following a bench trial for unsafe passing of a snow plow on a two-lane highway. We established that the snow plow does not yield at a stop sign, but rather slowly pulls out onto the highway at 10 mph.  Our client is 100 feet from the intersection traveling 45 mph.  There is no choice but to pass the snow plow on the left to avoid a rear-end collision.  The pass is nearly complete when the snow plow attempts a left-hand turn 200 feet ahead.  […]

Suppression of Urine Test Result Leads to OWI Dismissal WIN

Northwood, Worth County, Iowa.  The district court in Worth County granted the State’s motion to dismiss the charge of OWI, but not before suppressing the results of a urine test. A thorough review of traffic stop and implied consent videos revealed several issues that were briefed by the drugged driving attorneys at GRL Law, including whether: The deputy lacked reasonable suspicion to detain the driver; The deputy unreasonably prolonged the traffic stop to await a drug dog; The drug dog trespassed onto the vehicle turning the “free air sniff” into an unreasonable search; The handler cued the drug dog to […]

Colin Gave Me My Life Back

“NO ONE would be would be more deserving than Colin and his entire team.  I was from another state where medical marijuana was legal. Theft Charge Dismissed on Eve of Trial WIN

Fort Dodge, Webster County, Iowa.  The Webster County Attorney’s Office dismissed a single count of theft at the state’s expense against our client on the eve of jury selection.  The criminal trial attorneys at GRL showed once again how thoroughly developing a theory of defense through the aggressive pursuit of pretrial discovery, including interviewing and subpoenaing witnesses not listed by the state, often makes a significant impact on the state’s decision to move forward.  In this case, we raised enough reasonable doubt as to the issues of ownership and intent such that a NFG verdict seemed the only likely outcome.  […]

Class D Felony Marijuana Charge Dismissed WIN

New Hampton, Chickasaw County, Iowa.  A traffic stop for speeding by an out-of-state driver on Interstate 35 led to a warrantless probable cause search of the vehicle based on the odor of marijuana.  Deputies located significant quantities of marijuana flower in a glass jar in the passenger compartment and charged our client with both felony and misdemeanor possession under Iowa Code section 124.401.  The class D felony charge was punishable by an indeterminate term of prison of up to 5 years and a fine of $7,500. Both the stop and the search were legal under Iowa law.  However, as a […]

NOT GUILTY of Conspiracy to Commit Theft

Norwalk, Warren County, Iowa.  It took almost two years of fighting but persistence paid off.  The Iowa Court of Appeals agreed that GRL Law’s client was Not Guilty of Conspiracy to Commit Theft.  In a prosecution riddled with misconduct, GRL Law’s client was convicted of a crime she did not commit.  She waived her right to request a deferred judgment on the offense to ensure that she had the right to appeal the improper conviction. GRL Law pressed on defending her innocence pro bono (for free) on appeal to the Iowa Court of Appeals.  Due to the COVID-19 pandemic the […]

Des Moines, Polk County, Iowa.  Last man remaining at accident scene was accused of operating while intoxicated despite the fact that all evidence pointed to someone else as the driver.
