Humboldt, Humboldt County, Iowa. Nursing career saved when GRL Law discovered a violation of our client’s right to place phone calls after being arrested for Operating While Intoxicated. Our understandably emotional client repeatedly requested to place calls after she was arrested to check on the status of her dog, which the arresting officers left locked in her vehicle, parked on the shoulder of the highway. The arresting officer failed to give her the opportunity to place any calls prior to a decision being made regarding the breath test at the station. As a result, the prosecutor agreed that her decision regarding breath testing would have to be excluded and the charge was amended from Operating While Intoxicated to a simple misdemeanor, Reckless Driving. Driving privileges spared and OWI charge avoided. Future in the nursing profession saved as well.
