OWI third offense dismissed

Cass County Iowa.  Client was charged with operating while intoxicated third offense after a citizen had called him in for being parked on a gravel road.  The investigating officer stopped the client when he saw the client driving away from where the reporting party saw him.  Following the stop of his vehicle he was arrested and charged with OWI 3rd offense.  All the evidence in the case was ultimately thrown out because the officer did not have a constitutional basis to stop the client's vehicle.  As a result, the charge was dismissed and the client's license was saved.
