Guthrie County, Iowa. After GRL Law’s client was told his breaht test result he immediately requested to take the breath test again. The officer refused the request but also failed to advise GRL Law’s client of his right to independent testing. Consequently, the prosecution agreed that their breath test result must be excluded from trial and also agreed to dismiss the OWI charge. Driving privileges were also spared.
