Warren County, Iowa. Client was charged with operating while intoxicated first offense after refusing to submit to a breath test and the case proceeded to trial. A mistrial was declared when the jury could not reach a unanimous verdict with a split of 9-3 in favor of not guilty. Unwilling to resolve the charges following the first trial, the State sought to convict the client in a second trial which also resulted in a mistrial when the jury was split at 10-2 in favor of not guilty. Shortly before beginning the third trial, the State agreed to amend the charges to public intoxication and reckless driving.
