Vehicular Homicide Charge Dismissed

January 20, 2015.  Burlington, Des Moines County, Iowa.  Prosecutors, citing insufficient evidence, voluntarily dismissed Vehicular Homicide by way of Operating While Intoxicated charge, in fatal motel parking lot accident pursuant to a plea agreement reached with the defense.  Pursuant to the plea agreement, the defendant pleaded guilty to failing to return to an accident scene involving death.  The State has agreed to recommend probation and the defendant may request a deferred judgment.  The defendant was facing a mandatory 25 year prison sentence if convicted of the Vehicular Homicide by way of Operating While Intoxicated charge.
