Polk County, Iowa. Our client was charged with OWI first offense and upon first blush it did not appear as though the case was defendable. After having requested the documents detailing the breath test result, it was determined that the office did not run the correct breath test because it was a non-evidentiary test. The DOT was unable to suspended her license and the criminal charge for OWI was dismissed in exhange for the client's plea to reckless driving.
